Senators Challenge DOE Rule on Appliance Efficiency Standards

WASHINGTON — U.S. Senator Martin Heinrich (D-N.M.), Ranking Member of the U.S. Senate Energy and Natural Resources Committee, led a letter on Aug. 6 urging the U.S. Department of Energy (DOE) to withdraw a proposed revision to the Appliance and Equipment Standards Program process rule.
Last month, the DOE issued a Notice of Proposed Rulemaking that would revise the agency's Process Rule used to establish federal energy conservation standards for household appliances and equipment, including air conditioning systems.
The group of 18 senators said the proposed rule could weaken a federal efficiency standards program that has operated for nearly 40 years and potentially increase energy costs for American households, citing estimates from Lawrence Berkeley National Laboratory that existing efficiency standards have reduced total U.S. energy consumption by 6.5% and saved the average household $576 annually.
“At a time when energy prices are skyrocketing, this administration should be focused on making energy affordable and increasing grid capacity — not hamstringing a program that has consistently reduced bills for American families,” the Senators wrote.
The senators also stated that eliminating the program going forward could increase household utility bills by an estimated $150 per year, raise peak electricity demand by 32 gigawatts in 2040, and increase cumulative carbon dioxide emissions by nearly 1 billion metric tons through 2050.
The senators argued that federal law requires DOE to consider consumer impacts, manufacturer impacts, technological feasibility, and economic justification when developing efficiency standards. They said the proposed revisions could create additional requirements that would affect how future standards are evaluated.
The letter concluded by urging the DOE to withdraw the provision and implement the Appliance and Equipment Standards Program as Congress mandated.
