    Legal Questions
    ContractingBusiness.com had questions related to potential privacy issues that could result if a technician attempts to use a camera at a customer's home or business.

    Q: Does the user (such as an HVAC technician visiting a site) have to inform the resident that he is recording the visit?

    Q: Does the user need to obtain written or verbal permission to record the visit?
    A: it is best to record verbal permission on-camera, and if the party says "No", simply switch off the camera and go about your business.

    Q: Does this type of video recording override the regulations by a building owner related to their building's security rules? (Similar to "concealed carry" not applying when entering many buildings.)
    A: Video recording is not held to the same standards as concealed carry and most people carry mobile recording devices into buildings every day (cell phones, tablets, etc.). The key here is how the footage is used. If used to intentionally damage a company or person, then it is illegal, but the contractor/technician can use the footage for liability protection, civil litigation, etc. The footage recorded in homes/businesses also cannot be socialized in any way (uploaded to YouTube/Facebook/Twitter) unless given consent.
